These Terms and Conditions apply to every booking of a boat trip, charter or related service made with GMS YACHTING. By confirming a booking and paying the deposit, the client accepts these Terms, our Política de Cancelamento e Reembolso e as nossas opções de Política de Privacidade.
1. Who we are
GMS YACHTING is a trade name of TWILIGHTHARBOR, LDA, registered office: Rua das Musas 24, R/C, Parque das Nações, 1990-169 Lisboa, Portugal. Agency (visitor address): Passeio Neptuno 19C, Parque das Nações, 1990-170 Lisboa. NIF 518942503. Tourism animation operator registered with Turismo de Portugal under RNAAT n.º 335/2026. Email: contact@gmsyachting.com. Phone / WhatsApp: +351 912 827 448.
Trips are carried out with a professional skipper and crew, on vessels operated by GMS YACHTING or by duly licensed partner operators. The vessel, operator and departure point are confirmed in writing before payment.
2. Prices and VAT
Prices are in euros. The rates shown on the website are indicative and may be shown excluding VAT; the applicable VAT (6% or 23% depending on the service, and up to 23% for drinks, extras and fees) is always indicated, together with the total price including VAT, in the written quote sent before any payment.
We may change our prices at any time. A confirmed booking keeps the price and conditions accepted at the time of our confirmation.
Extras (catering, drinks, decoration, sunset fee, corkage fee, etc.) are charged only if agreed in advance.
3. Pre-reservations and bookings
A pre-reservation can be requested at our agency, by email, WhatsApp or through our social media.
A pre-reservation is valid for 7 days. It is not a firm booking.
A booking is only confirmed once GMS YACHTING has confirmed availability in writing e the deposit (50%) or the full price (100%) has been received.
4. Payment
Deposit: 50% of the total price when the booking is made.
Balance: the remaining 50%, plus any extra services, must be paid no later than 8 days before the trip, unless otherwise agreed in writing with a GMS YACHTING representative.
Accepted methods: bank transfer and the other methods indicated in the quote. Where payment is made by PayPal, a 5.5% fee may be added, only where permitted by law and always shown in the quote before payment.
If the balance is not paid on time, GMS YACHTING may treat the booking as cancelled by the client, and the Cancellation & Refund Policy applies.
5. Cancellations, changes and refunds
Cancellations by the client, date changes, bad weather and technical problems are governed by our Política de Cancelamento e Reembolso, which forms part of these Terms.
Right of withdrawal: under Article 17(1)(l) of Decreto-Lei n.º 24/2014, the 14-day right of withdrawal for distance contracts does not apply to leisure services booked for a specific date or period. Cancellations are therefore handled under our Cancellation & Refund Policy.
6. Weather and safety at sea
The skipper is the sole judge of whether navigation is safe. Light weather (cloudy sky, light rain, moderate wind) is not a reason for cancellation; the trip takes place normally and the route may be adapted for the guests’ comfort.
If strong wind, storm or other conditions put guests’ safety at risk, the trip is postponed at no extra cost, or refunded as set out in the Cancellation & Refund Policy.
7. Technical failure
If a technical failure of the vessel prevents the service, GMS YACHTING will offer a similar replacement vessel when available, a new date, or a refund of the amounts paid for the service not provided (in proportion to the unused time if the failure happens during the trip). Beyond this, no additional compensation is due, except where required by law.
8. Rules on board
8.1 Smoking
Electronic cigarettes are allowed only in the outside areas of the boat. Cigarettes and cigars are forbidden on the whole boat unless the captain authorises otherwise.
8.2 Food and drinks
For operational and quality reasons, guests may not bring their own food or drinks on board. If the client wishes to provide their own catering or drinks, prior written approval from GMS YACHTING is required; specific conditions and a corkage fee may apply, depending on the boat and the service.
8.3 Night trips
On trips starting after sunset, the boat cannot anchor, even if the trip lasts more than two hours. A sunset fee may apply depending on the boat and the service; it is always shown in the quote.
8.4 Behaviour on board
Access to cabins and bedrooms is forbidden unless the captain authorises it.
Do not throw paper or any other object into the toilets.
Do not touch the speakers or audio equipment.
The kitchen may only be used with a crew member present; drawers and fridges must not be opened without supervision.
It is forbidden to climb on tables, railings or the front of the flybridge, to hang outside the boat, or to play rough games or behave dangerously.
Guests must never touch the navigation or control equipment of the boat.
Guests must not be under the influence of drugs, and must drink alcohol responsibly. The skipper may refuse boarding to, or disembark, any person whose behaviour endangers the safety of others.
8.5 Safety
The instructions of the skipper and crew must be followed at all times. Failure to follow safety instructions may lead to the trip being ended immediately, without refund, to the extent permitted by law.
The boat carries life jackets, life buoys, a life raft and all mandatory safety equipment. The safety plan is displayed in the saloon.
For comfort and safety, guests are asked to remove their shoes on board, and to keep one hand free to hold on when moving along the sides of the boat. The deck may become slippery after swimming or because of the weather.
Crianças must be accompanied by a responsible adult at all times and wear a suitable life jacket. The number and ages of children must be declared when booking.
The maximum number of guests indicated for each boat cannot be exceeded.
8.6 Swimming and water activities
Nobody may enter the water without the crew’s permission. Swimming and diving must follow the crew’s instructions and safety conditions.
Stand-up paddle, snorkelling or diving may be suspended if the crew considers conditions unsafe.
8.7 Items and products forbidden on board
Shrimp, red fruits and red-wine based drinks.
Dark-coloured drinks, such as red sangria or black vodka.
Shishas, hookahs and water pipes.
Confetti, fireworks, sparklers and any pyrotechnic or light-effect items.
Any narcotic or illegal substance.
Glitter sunscreen, self-tanning products and body oils must not be applied on the sofas or cushions; please apply them in the toilets or saloon, in the appropriate areas.
9. Damage and client responsibility
The client is responsible for damage or loss caused to the vessel, its equipment and water-sports equipment by the client or their guests, through misuse or breach of these rules. Such damage will be charged at its actual repair or replacement cost, according to the damage schedule available on request, and the amount is due once the damage has been assessed and communicated to the client.
The client is responsible for their guests’ compliance with these Terms and with maritime, civil and criminal law. The vessel may not be used for any competition, for illegal purposes or for transporting illegal goods.
10. Personal belongings and liability
Guests must look after their personal belongings to avoid them falling into the sea. GMS YACHTING is not responsible for the loss of, or damage to, personal belongings or items left on board, except where caused by its own fault.
Nothing in these Terms excludes or limits GMS YACHTING’s liability for death or personal injury caused by its negligence, for wilful misconduct or gross negligence, or any other liability that cannot be excluded under Portuguese law. All limitations in these Terms apply only to the extent permitted by law.
As a tourism animation operator, GMS YACHTING holds the insurance required by Decreto-Lei n.º 108/2009.
11. Photos and videos
Guests may take photos and videos for private use. GMS YACHTING will only publish photos or videos where guests can be identified with their consent.
A complaints book (Livro de Reclamações) is available in physical and electronic form.
In case of a consumer dispute, the client may use the following alternative dispute resolution entity: CACCL – Centro de Arbitragem de Conflitos de Consumo de Lisboa, www.centroarbitragemlisboa.pt. More information on www.consumidor.gov.pt (Lei n.º 144/2015).
13. Applicable law
These Terms are governed by Portuguese law. Without prejudice to the mandatory rights of consumers, the courts of Lisbon have jurisdiction. If a clause is held invalid, the other clauses remain in force. If there is any difference between language versions, the English version prevails, unless the law requires otherwise.
